These terms apply when you visit hydrogenbuild.com, fill in one of its forms, or receive text messages from HydrogenBuild LLC ("HydrogenBuild", "we", "us"). By using the site or opting in to our messages, you agree to them. If you don't agree, please don't use the site or opt in.
1. Using the site
You may use hydrogenbuild.com to learn about our services and contact us. Please don't:
- send false information, or information about someone else without their permission;
- try to get around the spam check, overload the site, or access parts of it you aren't meant to;
- use the site or its forms to send spam, malware or anything unlawful.
How we handle the information you send is described in our privacy policy, which is part of these terms.
2. Free mockups and quotes
A free mockup is a concept design we make from your public business details. It costs nothing and doesn't commit you to anything. Prices shown on the site and quotes we send are estimates until both sides agree to them in writing; we may change our prices for new work at any time.
3. Paid services
When you hire us to build a website, provide a care plan or carry out a production readiness review, the scope, price, payment terms, timelines and ownership of the work are set out in a written proposal or agreement. If that agreement and these terms disagree, the agreement wins.
4. Text messaging (SMS and RCS)
Program: HydrogenBuild request and appointment updates. If you agree to receive texts, for example by ticking the text-message box on our contact form, ticking "OK to text me about this request" on our mockup form, or telling us in writing, we'll send text messages (SMS, MMS or RCS) to the mobile number you gave us.
- What we send: messages about your request, appointments or project only, such as confirming we received your request, asking a question, helping you book an appointment, offering available times, confirming and reminding you of appointments, letting you know your mockup or quote is ready, and updates on work you've hired us for. We don't send marketing or promotional messages.
- How often: message frequency varies with your request; usually a few messages per request or project.
- Cost: message and data rates may apply, according to your mobile plan. We don't charge for messages.
- Opting out: reply STOP to any message to stop receiving texts. We'll send one message confirming you've opted out and won't text you again unless you opt back in. You can also reply START to opt back in.
- Help: reply HELP to any message, or email hello@hydrogenbuild.com.
- Consent isn't required to buy: agreeing to texts is never a condition of a mockup, quote or purchase. You can reach us by email instead.
- Carriers: mobile carriers are not liable for delayed or undelivered messages. RCS messages need a supported phone and carrier; otherwise you may receive them as SMS instead.
- Your number: tell us if you change or give up your mobile number, so we don't text someone else.
We use your mobile number only to send these messages. We don't sell it or share it, or your consent to receive texts, with third parties or affiliates for their marketing. See our privacy policy.
5. Content and ownership
The site's text, design, logo and code belong to HydrogenBuild, and you may not copy them for commercial use without our permission. Mockups stay ours until you hire us and the agreement says otherwise. Anything you send us, such as your logo or photos, stays yours; you let us use it only to prepare your mockup, quote or project.
6. Disclaimers
The site and free mockups are provided "as is", without warranties of any kind. We work to keep the site accurate and available, but we don't promise it will always be error-free or online. Nothing on the site is legal, tax or financial advice.
7. Limitation of liability
To the extent the law allows, HydrogenBuild isn't liable for indirect, incidental or consequential losses arising from your use of the site, the free mockups or our text messages, and our total liability for them is limited to $100. Liability for paid services is governed by the agreement for that work.
8. Governing law
These terms are governed by the laws of the State of New Jersey, USA. Any dispute about them will be handled by the state or federal courts located in New Jersey.
9. Changes to these terms
If we change these terms, we'll update the date at the top of this page. Changes apply from that date; continuing to use the site or receive our messages afterwards means you accept them.
